Procedure to requisition services under section 247(5) and to make a reference under section 247(9)

Rules 131-200

Rule 149 lets senior officers approve persons whose services may be requisitioned, or valuers to whom valuation references may be made, on an application in Form No. 85, decided within six months, with a Designated Approval Number, and allows requisition of an unapproved person if approval follows within thirty days.

Approval (sub-rules 1 to 5). A Principal Chief Commissioner, Chief Commissioner, Principal Director General or Director General may approve any person or entity whose services may be requisitioned under section 247(5)(b), and the Valuation Officer, person registered under section 514, or other person, entity or registered valuer to whom a reference may be made under section 247(9). Approval is on application, on a reference by a specified senior officer, or on the approving officer's own motion. The authorised officer may requisition or refer to one or more approved persons. The application is made in Form No. 85 and is decided, granting or rejecting, within six months from the end of the month it is made. On approval, a Designated Approval Number may be issued.

Unapproved persons (sub-rule 6). Where the authorised officer considers it necessary or expedient, the officer may requisition or refer to a person who is not approved, after recording reasons and within thirty days obtaining the approval of the Principal Chief Commissioner, Chief Commissioner, Principal Director General or Director General.

Definitions (sub-rules 7 and 8). A "registered valuer" is any valuer registered by or under any law in force; a "Designated Approval Number" is a number having alphanumeric characters.
