Rules 131-200

Rule 200 prescribes Form No. 120 for an advance ruling application by a resident or non-resident, with fees that depend on the category of applicant and the amount of the transaction — from Rs. 10,000 for any other applicant to ten lakh rupees for large transactions — and electronic signing and furnishing.

Form (sub-rule 1). The application under section 383(1) is in Form No. 120, verified as the form indicates.

Fees (sub-rule 2). Rulings on the tax liability from a transaction undertaken or proposed by a non-resident applicant (section 380(a)(i)) or a resident applicant (section 380(a)(ii)): Rs. 2,00,000 where the amount is less than one hundred crore rupees; Rs. 5,00,000 where between one hundred and three hundred crore rupees; and ten lakh rupees where more than three hundred crore rupees. Rulings on the tax liability of a resident applicant from a transaction under section 380(a)(iii): Rs. 5,00,000 for an amount between one hundred and three hundred crore rupees, and ten lakh rupees above three hundred crore rupees. Any other applicant: Rs. 10,000 in all cases.

Signing and furnishing (sub-rules 3 and 4). The application, verification, annexures and documents are furnished electronically. For an applicant who must file a return, they are signed by the person authorised under section 265, under digital signature if the return must be so furnished, otherwise through electronic verification code. For an applicant who need not file a return, they are signed by a person holding a valid power of attorney, using digital signature or electronic verification code as the Board specifies. Proof of payment of the fee accompanies the application.
