Rules 201-260

Rule 218 sets when and how tax deducted or collected at source, and tax paid under section 392(2)(a), reaches the Central Government: same day or seven days for Government offices, seven days or 30th April for others, thirty days for challan-cum-statement cases, and optional quarterly payment.

Corresponding 1962 rules: rules 30 and 37CA.

Government offices (sub-rule 1). Sums deducted or collected under Chapter XIX-B, or deductible under section 392(2), by an office of the Government are paid on the same day where paid without an income-tax challan, and on or before seven days from the end of the month of deduction or collection (or in which tax is due under section 392(2)(a)) where paid with a challan.

Other deductors and collectors (sub-rule 2). On or before 30th April where the amount is credited, paid, debited or received in March; otherwise on or before seven days from the end of the month in which the deduction or collection is made, or income-tax is due under section 392(2)(a).

Challan-cum-statement cases (sub-rule 3). Tax deducted under section 393(1) on the following is paid within thirty days from the end of the month of deduction, with a challan-cum-statement in Form No. 141:

  • rent ([Table: Sl. No. (2)(i)]);
  • consideration for transfer of immovable property other than agricultural land ([Table: Sl. No. (3)(i)]);
  • sums for carrying out work under a contract (including supply of labour), fees for professional services, or commission (not insurance commission under [Table: Sl. No. (1)(i)]) or brokerage ([Table: Sl. No. (6)(ii)]); and
  • consideration for transfer of a virtual digital asset ([Table: Sl. No. (8)(vi)]).

Quarterly payment (sub-rule 4). In special cases, the Assessing Officer may, with prior approval of the Joint Commissioner, permit quarterly payment of tax deducted under section 392(1) or 393(1) [Table: Sl. Nos. (1)(i) and (ii), and 5(ii) and (iii)]: by 7th July for the quarter ending 30th June, 7th October for 30th September, 7th January for 31st December, and 30th April for 31st March.

Government book adjustment (sub-rules 5 to 8). Where a Government office pays without a challan, the Pay and Accounts Officer, District Treasury Officer, Cheque Drawing and Disbursing Officer or other person responsible for crediting the sum submits a statement in Form No. 137 to the Director General of Income-tax (Systems) or authorised person — by 30th April for March, otherwise within fifteen days from the end of the month. That person intimates the Book Identification Number to each deductor or collector, and obtains an Account Office Identification Number (AIN) for filing Form No. 137 by filing Form No. 136.

Where and how to deposit (sub-rules 9 to 11). Tax paid with a challan goes into any branch of the Reserve Bank of India, the State Bank of India or an authorised bank. Persons referred to in rule 333, and those paying with a challan-cum-statement under sub-rule (3), remit electronically. The Director General of Income-tax (Systems) specifies the procedure, formats and standards for electronic remittance and administers it.
