Rules 2026 · Rule 221

Form for furnishing certificate of accountant under section 398(2) for person responsible for deduction or collection of tax as per section 394(1) [Table: Sl. Nos. 1 to 5 and 9] not to be deemed to be an assessee in default

Rules 201-260

Rule 221 prescribes Form No. 149 (non-deduction or short deduction) and Form No. 150 (non-collection or short collection) for the accountant's certificate under section 398(2), furnished to the Director General of Income-tax (Systems).

Corresponding 1962 rule: rule 31ACB (Form No. 149 replaces Form No. 26A).

The forms (sub-rule 1). The certificate of an accountant, as defined in section 515(3)(b), under section 398(2) is furnished in Form No. 149 for non-deduction or short deduction of tax, and in Form No. 150 for non-collection or short collection of tax.

To whom (sub-rule 2). To the Director General of Income-tax (Systems) or the person authorised by him.

Context. The rule's heading ties the certificate to a person responsible for deduction, or for collection under section 394(1) [Table: Sl. Nos. 1 to 5 and 9], not being deemed an assessee in default. The conditions for that relief are in section 398(2), not in this rule.
