Removal from register of names of valuers and restoration

Rules 201-260

Rule 249 lets the senior Commissioner or Director General remove a valuer from the register for registration by error or misrepresentation, or for conviction with imprisonment or misconduct, after a hearing, restore a name for sufficient cause, review all registered valuers once in five years, and hold inquiries with civil-court powers.

Removal (sub-rule 1). After giving a reasonable opportunity of being heard and any further inquiry, the Principal Chief Commissioner, Chief Commissioner, Principal Director General or Director General may remove a name if satisfied that it was entered by error or on account of misrepresentation or suppression of a material fact, or that the person has been convicted of an offence and sentenced to imprisonment, or guilty of malpractice or misconduct in his professional capacity that makes him unfit to remain on the register.

Restoration and review (sub-rules 2 and 3). A removed name may be restored on application and sufficient cause. Once in five years the authority reviews the performance of all registered valuers and may, after a hearing, remove a name if the performance is such that it should not remain.

Inquiry (sub-rule 4). The authority may conduct the inquiry itself or appoint an Inquiry Officer not below the rank of Joint Commissioner of Income-tax, with the powers of a court under the Bharatiya Nyaya Sanhita, 2023 for discovery and inspection, enforcing attendance and examining on oath (including bank officers), compelling production of books and documents, and issuing commissions.
