Nomination (approved gratuity fund)

Rules 311-333

Rule 319 lets an employee, if the trustees allow, nominate persons in Form No. 184 to receive gratuity on death, in favour of family members where there is a family, with shares stated, guardian provisions for minors, and rules on invalidity and modification.

The rules. The nomination is in Form No. 184, or a form as near as necessary, giving one or more persons the right to receive the gratuity if the employee dies before it becomes payable or, having become payable, before it is paid (sub-rule 1). Where several persons are nominated, the share for each is specified so as to cover the whole gratuity (sub-rule 2). If the employee has a family when nominating, the nominees must belong to the family and a nomination of a non-member is invalid; if there is no family, anyone may be nominated, but the nomination becomes invalid if the employee later acquires a family, and a fresh nomination may then be made (sub-rules 3 and 4). A nomination can be modified at any time by written notice in Form No. 184; if the nominee dies first, that interest reverts to the employee, who may nominate again; a nomination or modification takes effect to the extent valid on the date the trustees receive it (sub-rules 5 and 6). For a minor nominee the member may appoint a major member of the family as guardian, or if there is none, any other person (sub-rule 7).

"Family" (sub-rule 8). For a male employee: himself, his wife, his children (married or unmarried), his dependent parents, the dependent parents of his wife, and the widow and children of a predeceased son. For a female employee: herself, her husband, her children, her dependent parents, the dependent parents of her husband, and the widow and children of a predeceased son.
