Rules 22-48

Rule 33 lists the conditions a research association must meet to be approved for deduction on scientific research expenditure: sole object, own research, audited books, a donations statement, an annual statement of its research, and reports by the Commissioner on defaults.

Conditions.

  • Sole object. To undertake scientific research, or research in social science or statistical research, as the case may be; and the association carries on the research itself (sub-rules 1 and 2).
  • Books and audit. Books of account are maintained and audited by an accountant (section 515(3)(b)), and the signed and verified audit report is furnished to the jurisdictional Commissioner by the section 263(1) return due date (sub-rule 3).
  • Donations statement. A separate statement of donations received and the amount applied for research, certified by the auditor, accompanies the audit report (sub-rule 4).
  • Annual statement. By the return due date, a statement to the Commissioner giving a detailed note on the research work of the tax year, a summary of research articles published in national or international journals, any patents or similar rights applied for or registered, and the programme and financial allocation for the coming tax year (sub-rule 5).

Reports by the Commissioner (sub-rule 6). If the Commissioner finds that the association is not maintaining books, has failed to furnish its audit report, has not furnished the donations or annual statements, has ceased its research or its activities are not genuine, or is not fulfilling the approval conditions, the Commissioner may, after inquiries, report to the Central Government within six months from the date of furnishing the return under section 263(1).
