STATUTORY ARCHITECTURE — 18-ROW MAP
Function in the statutory architecture
Section 80CCH applies to an individual enrolled in the Agnipath Scheme and subscribing to the Agniveer Corpus Fund on or after 1 November 2022. Under sub-section (1), the individual is allowed a deduction of the whole of the amount paid or deposited by him in the previous year in his account in the Fund. Under sub-section (2), where the Central Government contributes to his account, he is allowed a deduction of the whole of that contribution. There is no monetary limit in either sub-section.
The "Agnipath Scheme" is the scheme for enrolment in the Indian Armed Forces introduced by the Ministry of Defence letter dated 29 December 2022, and the "Agniveer Corpus Fund" holds the Agniveers' contributions and matching Government contributions with interest on both.
Operative consequences
Status
Operative for assessment year 2026-27. The Act's note records that the section was inserted by Act No. 8 of 2023, w.e.f. 1-4-2023. The Finance Act, 2026 does not amend s. 80CCH.
The Income-tax Act, 1961 governs assessment year 2026-27 and earlier years; the Income-tax Act, 2025 governs tax year 2026-27 onwards. For this subject, the corresponding provision is s. 125.
Case Laws & Commentary
SECTION 80CCH — DEDUCTION IN RESPECT OF CONTRIBUTION TO THE AGNIVEER CORPUS FUND
Case Laws & Commentary (Income-tax Act, 1961 as amended by Finance Act, 2026)
STATUTORY SCHEME (editorial summary)
Marginal heading: Deduction in respect of contribution to Agnipath Scheme.
Section 80CCH provides that an assessee, being an individual enrolled in the Agnipath Scheme and subscribing to the Agniveer Corpus Fund on or after 1 November 2022, shall be allowed a deduction of the whole of the amount deposited by him in his account in the Agniveer Corpus Fund (sub-section (1)). Sub-section (2) allows a deduction of the whole of the contribution made by the Central Government to the Agniveer's account, which is first included in the assessee's income under section 17. Under the default section 115BAC regime only the sub-section (2) deduction for the Government's contribution is allowed; the Agniveer's own deposit under sub-section (1) is not (section 115BAC(2)(i)).
A. SECTION COMMENTARY
A.1 Structural position
Section 80CCH is the newest Chapter VIA deduction, introduced to give effect to the tax treatment of the Agnipath Scheme. It is unusual in two respects: the whole of the contribution is deductible (no monetary cap and outside the section 80CCE ceiling), and the sub-section (2) deduction for the Government's contribution is available even to assessees taxed under the default regime.
A.2 Provision taxonomy
Two limbs: sub-section (1) deducts the Agniveer's own contribution; sub-section (2) first includes the Central Government's matching contribution in income (read with section 17) and then deducts it, producing a net-nil effect on that component. The corpus and its accretions are exempt on receipt under section 10(12C).
A.3 Core doctrinal themes
The provision is new and has generated no appellate litigation. The points to watch are the date of enrolment / subscription (on or after 1 November 2022), the inclusion-then-deduction mechanism for the Government's contribution, and the availability of only the sub-section (2) deduction under the new regime.
A.4 Legislative evolution / FA amendment trail
Inserted by the Finance Act, 2023, with effect from assessment year 2023-24 (some elements applied from assessment year 2024-25), to give statutory effect to the Agnipath Scheme, 2022. Not amended by the Finance Act, 2026.
A.5 CA practitioner pointers
(1) Deduct the whole of the Agniveer's contribution under sub-section (1) — there is no cap and it is outside section 80CCE. (2) For the Government's contribution, include it in income (section 17) and claim the matching deduction under sub-section (2). (3) The sub-section (2) deduction is available even under the section 115BAC default regime — a rare feature; the sub-section (1) deduction is not. (4) Corpus receipts are exempt under section 10(12C).
B. FA 2026 IMPACT NOTE
Section 80CCH is NOT amended by the Finance Act, 2026. The full-contribution deduction continues; under the default section 115BAC regime only the sub-section (2) deduction for the Government's contribution is available for assessment year 2026-27.
C. CASE LAW — CLUSTERED BY ISSUE
Cluster C-1 : A new, uncapped deduction, partly available under the new regime
Statutory scheme of section 80CCH (no reported case law yet)
Facts: An Agniveer enrolled under the Agnipath Scheme contributes to the Agniveer Corpus Fund and the Central Government makes a matching contribution.
Issue: How the own and Government contributions are treated.
Held: The own contribution is wholly deductible under sub-section (1); the Government contribution is included in income and then wholly deducted under sub-section (2); the corpus is exempt on receipt under section 10(12C). Only the sub-section (2) deduction is available under the default regime.
Ratio: Full deduction of both contribution streams, uncapped and outside section 80CCE, with only the sub-section (2) deduction available under the new regime.
Relevance: As a provision effective only from assessment year 2023-24, section 80CCH has generated no reported appellate authority; the statutory text and the section 10(12C) exemption govern.
