A. COMMENTARY
Why it is on the page
Section 276AA penalised non-compliance with section 269AB (registration of certain agreements and powers of attorney) or section 269-I (vesting of property in the Central Government) — provisions of Chapter XX-A, the now-historic code for acquisition of immovable properties where the apparent consideration understated the fair market value. It was inserted by the Income-tax (Amendment) Act, 1981 with effect from 1 July 1982 and omitted by the Finance Act, 1986 with effect from 1 October 1986. The Treatise reproduces it, with its omission note, so that no section number in Chapter XXII is skipped.
Context — the demise of Chapter XX-A
Chapter XX-A itself ceased to apply to transfers after 30 September 1986, being superseded first by the Chapter XX-C pre-emptive purchase regime and ultimately by the substantive anti-understatement provisions (sections 50C, 43CA and 56(2)(x)). Section 276AA fell with the scheme it served. It has no present operation and is set out only to preserve the integrity of the numbering.
B. STATUTORY TEXT (verbatim — pre-Finance Act, 2026 text)
Reproduced verbatim as an omission note; the substantive section was repealed with effect from 1 October 1986 and is not affected by the Finance Act, 2026.
276AA. [Omitted by the Finance Act, 1986, w.e.f. 1-10-1986. Original section was inserted by the Income-tax (Amendment) Act, 1981, w.e.f. 1-7-1982.]
