Section 118 — CO-OPERATIVE BANK REORGANISATION LOSS CARRY-FORWARD (1961 s. 72AB SUCCESSOR)

Section 118 is the substantive equivalent of 1961 s. 72AB. Where a co-operative bank undergoes business reorganisation (amalgamation / demerger / conversion to banking-company), the predecessor's accumulated loss and unabsorbed depreciation are inherited by the successor, subject to specified conditions on continuity / asset-utilisation / shareholding.

PLANNING NOTES

(i) For multi-state co-operative bank consolidation projects (frequent post-RBI 2019 master direction), s. 118 is the loss-inheritance gateway. (ii) Maintain documentary trail per s. 65 conversion-definitions; failure forfeits inheritance. (iii) RBI / Registrar-of-Co-operative-Societies orders are the primary evidence.
