INTRODUCTION

• (a) OFFICER'S PROCEDURAL WORKFLOW — the step-by-step sequence the officer is trained to execute.

• (b) DEPARTMENTAL VIEW PER SECTION — the substantive position the Department takes on each operative section.

• (c) PRACTITIONER COUNTER-STRATEGY — the defence structure aligned to the Departmental approach.

The document covers the operationally critical chapters where the Departmental procedural framework is most consequential: Registration (VI), Returns (IX), Refunds (XI), Assessment (XII), Audit (XIII), Inspection / Search / Arrest (XIV), Demands and Recovery (XV), Advance Ruling (XVII), Appeals and Revision (XVIII), Offences and Penalties (XIX), and Transitional Provisions (XX). For each of these, the playbook is paired with the full section commentary; this document complements but does not replace the substantive section files.

CHAPTER VI — REGISTRATION | OFFICER'S PLAYBOOK

Handbook reference: Chapter II — Registration, pp 56-70.

(a) OFFICER'S PROCEDURAL WORKFLOW

Step 1: Receipt of REG-01

Verify completeness; check PAN; trigger Aadhaar authentication per Rule 8(4A).

Step 2: Risk flagging

Document-based + GSTN-AI flagging; physical verification under Rule 9 for high-risk applicants.

Step 3: Physical verification (where needed)

Within prescribed days; report in REG-30.

Step 4: Approval / clarification (REG-03)

Approval in REG-06 within 7 working days (Aadhaar-authenticated) / 30 days otherwise; or seek further information in REG-03.

Step 5: Post-grant supervision

Monitor GSTR-3B filing; GSTR-3A under Rule 68 for defaulters; suspension under s. 29; cancellation per s. 29(2).

Step 6: Revocation handling

REG-21 application within 30 days of cancellation (extendable); examine cure-of-defaults.

(b) DEPARTMENTAL VIEW PER SECTION

• s. 22 — Threshold based on aggregate turnover under s. 2(6); State / UT-wise; Rs. 40 lakh (exclusive-goods supplier in non-special-category States); Rs. 20 lakh / Rs. 10 lakh other categories. PAN-level aggregation.

• s. 23 — Persons exclusively engaged in non-taxable / exempt supplies, agriculturists in respect of own produce, and Government-notified categories. Strictly construed; aggregate-turnover test still applies.

• s. 24 — Compulsory categories regardless of threshold: inter-State supply (with carve-out for services under Notification 10/2017-IT), casual taxable persons, RCM recipients, NRs, TDS deductors, TCS collectors (ECO), ISD, agent on behalf of principal, etc. Department's first check on any unregistered supplier.

• s. 25 — Within 30 days of becoming liable; place-of-business-wise GSTIN. Aadhaar authentication is operationally non-negotiable.

• s. 26 — Deemed registration in some pre-GST migration / portal-failure cases; rarely operative now.

• s. 27 — Casual / NR persons: advance deposit equivalent to estimated tax liability; 90-day initial validity; extension by 90 days.

• s. 28 — Amendment via REG-14 within 15 days of change.

• s. 29 — Cancellation grounds — voluntary closure, transfer / amalgamation, ceasing to be liable, fraud / wrong info, contravention. Suo-motu cancellation under sub-s. (2) for specified defaults.

• s. 30 — Revocation within 30 days (extendable by Commissioner / Joint Commissioner up to further 30 days each — total 90 days).

(c) PRACTITIONER COUNTER-STRATEGY

• Threshold disputes — recompute aggregate turnover under s. 2(6) carefully; exclude items the Department often wrongly includes (e.g., supplies on which RCM is paid by recipient).

• Inter-State services Rs. 20 lakh threshold — invoke Notification 10/2017-IT.

• Cancellation defence — document compliance cure (return filings, payments); approach Suguna Cutpiece Centre HC line.

• Revocation discipline — 30-day window from cancellation; do not allow lapse.

• Physical verification — produce comprehensive documentation; address officer queries promptly.

CHAPTER IX — RETURNS | OFFICER'S PLAYBOOK

Handbook reference: Chapter III — Returns & Scrutiny Thereof, pp 71-100.

(a) OFFICER'S PROCEDURAL WORKFLOW

Step 1: Monitor periodic returns

GSTR-1 (11th); GSTR-3B (20th / staggered for QRMP 22nd / 24th); GSTR-9 / 9C (31 December of next FY).

Step 2: Defaulter tracking

System-generated GSTR-3A under Rule 68; 15-day window before s. 62 escalation.

Step 3: Scrutiny — risk-based selection

Per Instruction 02/2022-GST & 02/2023-GST SOP — GSTR-1 vs GSTR-3B mismatch; GSTR-3B vs GSTR-2A / 2B mismatch; e-way bill data; RCM under-reporting; ineligible ITC; declared exempt vs taxable turnover.

Step 4: ASMT-10 — specific discrepancy notice

Articulate parameter; quantum; tax period; 30-day reply window.

Step 5: Examine ASMT-11 reply

On merits — documentary verification; Circular 183 / 193 CA-certificate framework for ITC mismatch.

Step 6: Closure or escalation

ASMT-12 closure on acceptable explanation; otherwise escalate to s. 65 / 66 / 67 / 73 / 74.

(b) DEPARTMENTAL VIEW PER SECTION

• s. 37 — GSTR-1 monthly / IFF for QRMP; corrective amendments now in GSTR-1A (added 2024).

• s. 38 — GSTR-2B is the operative statement of ITC; IMS (Invoice Management System, Oct 2024+) imposes recipient action on every invoice.

• s. 39 — GSTR-3B as the principal self-assessed return; Bharti Airtel SC is decisive on rectification.

• s. 41 — Provisional acceptance of ITC; s. 41(2) auto-reversal mechanism operationalised through Rule 37A.

• s. 42-43A — Omitted by FA 2022; the matching regime never operationalised.

• s. 44 — Annual return GSTR-9 + reconciliation GSTR-9C (above turnover threshold); historical late-fee waivers tracked.

• s. 45 — Final return GSTR-10 within 3 months of cancellation; failure attracts s. 47 late fee and ASMT-13.

• s. 46 — Notice to defaulters in GSTR-3A; precursor to s. 62.

• s. 47 — Late fee Rs. 100 / day per Act with caps (varying notifications); Rs. 500 / day for annual returns / Rs. 200 / day for nil — track active waiver notifications.

• s. 48 — GST practitioners empanelled; act on behalf of registered persons.

(c) PRACTITIONER COUNTER-STRATEGY

• Bharti Airtel — file missed-ITC claim in subsequent GSTR-3B within s. 16(4); do not pursue historical rectification.

• ITC mismatch defences — Circular 183 / 193 CA-certificate route for FY 2017-18 to 2020-21.

• ASMT-10 generic / bland — challenge for absence of specific discrepancy.

• IMS discipline — train teams; pending / rejected invoices have downstream ITC consequences.

• Late fee — leverage active waiver notifications under s. 128.

CHAPTER XI — REFUNDS | OFFICER'S PLAYBOOK

Handbook reference: Chapter VI — Refund Under GST, pp 130-152.

(a) OFFICER'S PROCEDURAL WORKFLOW

Step 1: Receipt of RFD-01

Categorise — zero-rated exports / inverted-duty / excess balance / deemed exports / others.

Step 2: Acknowledgement RFD-02

Within 15 days of application.

Step 3: Provisional refund RFD-04

90% for zero-rated exports within 7 days; conditions per Rule 91.

Step 4: Verification

Examine eligibility, quantum computation (Rule 89(4) for zero-rated; Rule 89(5) for inverted-duty post-VKC), unjust-enrichment under s. 54(8).

Step 5: Show-cause if denial proposed

RFD-08 deficiency / SCN; opportunity to reply.

Step 6: Sanction in RFD-06

Final order; disbursement via PFMS; interest under s. 56 if delayed beyond 60 days.

Step 7: Reject or accept

Reasoned order; appeal under s. 107 within 3 months.

(b) DEPARTMENTAL VIEW PER SECTION

• s. 54 — 2-year limitation from relevant date; categories under sub-s. (3) — zero-rated, inverted duty, unutilised ITC; s. 54(8) unjust enrichment is the central safeguard.

• VKC Footsteps SC — inverted-duty refund formula excludes input services; Rule 89(5) upheld.

• Mafatlal SC + s. 54(8) — bearer of incidence must establish non-passing-on; refund to CWF where unjust enrichment cannot be ruled out.

• s. 55 — Notified entities (UN / MFI / embassies / consulates) — UIN-based refund; reciprocity for missions; minimum invoice Rs. 5,000.

• s. 56 — 6% interest after 60 days; Saraf Natural Stone HC — automatic; Ranbaxy Laboratories SC — clock not resettable.

• s. 57 — Consumer Welfare Fund — destination for unrefunded amounts due to unjust enrichment.

• s. 58 — Fund utilisation by Government on Council's recommendation.

(c) PRACTITIONER COUNTER-STRATEGY

• 2-year clock — diary from relevant date precisely; for s. 77 / s. 19 IGST cases, from date of correct-tax payment per Circular 162.

• Unjust enrichment — for B2B supplies where recipient has not claimed ITC, certificate of non-passing-on is operationally feasible.

• Inverted-duty refund — segregate input-goods ITC from input-services ITC; only former is refundable.

• Section 56 interest — pursue automatically; do not let Department defer to discretionary computation.

• Delay beyond 60 days — invoke Saraf Natural Stone; HC writ for mandamus where Department refuses.

CHAPTER XII — ASSESSMENT | OFFICER'S PLAYBOOK

Handbook reference: Chapter IV — Assessment, pp 101-114.

(a) OFFICER'S PROCEDURAL WORKFLOW

Step 1: Self-assessment monitoring

Routine — verify returns filing and tax payment.

Step 2: Provisional assessment s. 60

On ASMT-01 application — examine reasons; ASMT-04 order within 90 days; bond + security per Rule 98.

Step 3: Scrutiny s. 61

ASMT-10 / 11 / 12 — covered in Returns playbook above.

Step 4: Non-filer s. 62

After GSTR-3A and 15-day window; ASMT-13 best-judgement based on available material.

Step 5: Unregistered s. 63

ASMT-14 SCN with mandatory hearing under proviso; ASMT-15 order.

Step 6: Summary s. 64

Addl. / Jt. Commissioner sanction; ASMT-16; 30-day withdrawal under sub-s. (2).

(b) DEPARTMENTAL VIEW PER SECTION

• s. 59 — Self-assessment is the ordinary rule; GSTR-3B is the operative self-assessed return.

• s. 60 — Provisional assessment is exceptional; for genuine value / rate uncertainty; 6-month finalisation (extendable up to 4 years by Commissioner).

• s. 61 — Scrutiny is fact-finding, not adjudication; escalation only on unsatisfactory explanation.

• s. 62 — Best-judgement based on relevant material; quantum often estimated from GSTR-1 / e-way bill / banking data; 30-day auto-withdrawal on valid return.

• s. 63 — Mandatory hearing under proviso; 5-year limitation from due date of annual return.

• s. 64 — Protective device; not adjudication; 30-day withdrawal route preserves natural justice.

(c) PRACTITIONER COUNTER-STRATEGY

• Provisional assessment — invoke only for genuine difficulty; document the reasoning.

• Non-filer auto-withdrawal — file valid return within 30 days of ASMT-13 service; tax + interest + late fee survive but best-judgement quantum falls away.

• Unregistered — recompute aggregate turnover; mandatory hearing under proviso; ITC under s. 18(1)(a) on inputs in stock.

• Summary ASMT-16 — file ASMT-17 withdrawal application within 30 days as default response.

CHAPTER XIII — AUDIT | OFFICER'S PLAYBOOK

Step 5: Time discipline

3-month statutory completion; extendable by 6 months on Commissioner's recorded reasons.

Step 6: Findings communication

Within 30 days of conclusion (ADT-02); rights, reasons, recommendations.

Step 7: Escalation

Where shortfall detected — separate s. 73 / 74 SCN; ADT-02 is fact-finding only.

Step 8: Special audit s. 66

Asst. Commissioner-or-above opinion + Commissioner approval; ADT-03 direction; nominated CA / CMA; 90+90 day cap; ADT-04 conclusion; sub-s. (4) hearing on material gathered.

(b) DEPARTMENTAL VIEW PER SECTION

• s. 65 — Audit is structured fact-finding with statutory time discipline (3+6 months); ADT-02 findings feed s. 73 / 74 but the SCN must independently engage substantive law.

• s. 66 — Special audit deployed for complex / high-value cases (related-party valuation, large taxpayer ITC patterns, sectoral complexity); the cost is Departmental and the CA / CMA is independent.

(c) PRACTITIONER COUNTER-STRATEGY

• Audit-readiness — reconciliations (GSTR-1 / 3B / 2B / 9 / 9C / books) maintained year-round; voluntary corrections via DRC-03 with interest as appropriate.

• ADT-01 — verify Commissioner's authorisation reference; track time-limits.

• Engage with draft findings before ADT-02 — additional documentation at this stage often more effective than post-ADT-02 contest.

• Time-limit defence — audit running beyond 3+6 months is vulnerable unless Commissioner has recorded extension with reasons.

• Special audit ADT-03 — examine authority chain (Asst. Commissioner + Commissioner) and reasoned opinion; sub-s. (4) hearing is mandatory before any reliance on findings.

CHAPTER XIV — INSPECTION, SEARCH, SEIZURE AND ARREST | OFFICER'S PLAYBOOK

Handbook reference: Chapter VIII — Inspection, Search, Seizure and Arrest, pp 173-197.

(a) OFFICER'S PROCEDURAL WORKFLOW

Step 1: Risk assessment

Step 2: Authorisation

Joint Commissioner-or-above ‘reasons to believe’ — recorded in writing; INS-01 authorisation for inspection / search / seizure.

Step 3: Search execution

Two independent witnesses (Cr.P.C. s. 100); time-stamped panchnama (INS-02); itemised seizure list (INS-03).

Step 8: Access to premises s. 71

Joint Commissioner-or-above authorisation; 15 working days for record production.

(b) DEPARTMENTAL VIEW PER SECTION

• s. 67(1) — Inspection — broader than search; suppression / excess ITC / contravention grounds.

• s. 67(2) — Search / seizure — narrower; secreted documents / goods liable to confiscation; INS-01 authorisation jurisdictional.

• s. 67(6) — Provisional release — bond + security (Rule 140) or monetary payment.

• s. 67(7) — 6+6 month seizure cap; mandatory return if no notice within window.

• s. 68 — E-way bill compliance; FA 2022 framework on detention; Circular 41 / 64 (interception SOP / minor errors).

• s. 69 — Arrest is exceptional, not routine; Commissioner's recorded reasons jurisdictional.

• s. 70 — Summons is investigative; deemed judicial proceeding.

• s. 71 — Access for audit / scrutiny / verification — narrower than search.

• s. 72 — Multi-agency assistance; coordination not displacement of proper officer.

(c) PRACTITIONER COUNTER-STRATEGY

• Demand INS-01 authorisation; verify Joint Commissioner-or-above signing.

• Seek recorded reasons via RTI / Court — bald / generic reasons are structurally weak.

• Panchnama discipline — two independent witnesses, time-stamps, itemised list; defects preserve for prosecution defence.

• Exercise sub-s. (5) right to copies / extracts on the spot.

• Provisional release — file application within days; bond / security or monetary release.

• Track 6+6 month seizure cap — automatic return on default.

• Arrest exposure — anticipatory bail (Cr.P.C. s. 438) for Rs. 5 crore + cases; pre-emptive engagement reduces necessity assessment.

• Summons — factual answers; no admissions; read carefully before signing; retract under affidavit if duress.

• DRC-01A intimation — settle if substantive concession warranted; no penalty.

• 30-day post-SCN settlement (s. 73(8)) — no penalty; cost-effective closure.

• For s. 74 SCN — primary defence: challenge fraud articulation; alternative-relief plea under s. 73 with 3-year limitation.
