Function in the statutory architecture
Section 80-IAB gives a Developer of a Special Economic Zone notified on or after 1 April 2005 under the Special Economic Zones Act, 2005 a deduction of one hundred per cent of the profits and gains derived from the business of developing the zone, for ten consecutive assessment years. The Developer chooses the ten years out of the fifteen years beginning with the year in which the zone was notified by the Central Government.
The section does not apply to a Developer where the development of the zone begins on or after 1 April 2017. Where a Developer's profits had earlier been excluded under s. 80-IA(13), it is entitled only for the unexpired part of the ten years. Where a Developer transfers operation and maintenance of the zone to a transferee Developer, the transferee gets the deduction for the remaining years. "Developer" and "Special Economic Zone" take their meanings from s. 2(g) and (za) of the Special Economic Zones Act, 2005.
Operative consequences
Status
Operative, but time-limited: available for assessment year 2026-27 only to a Developer whose zone development began before 1 April 2017 and whose chosen ten-year period includes that year. The Finance Act, 2026 does not amend s. 80-IAB.
The Income-tax Act, 1961 governs assessment year 2026-27 and earlier years; the Income-tax Act, 2025 governs tax year 2026-27 onwards. For this subject, the corresponding provision is s. 139, which continues the deduction on the 1961 computation for the remaining years.

STATUTORY SCHEME (editorial summary — verbatim bare-Act text in the companion Block-1 file)
Marginal heading: Deductions in respect of profits and gains by an undertaking or enterprise engaged in development of Special Economic Zone.
Section 80-IAB allows a Developer of a Special Economic Zone, notified on or after 1 April 2005 under the Special Economic Zones Act, 2005, a deduction of 100 per cent of the profits and gains derived from the business of developing the SEZ, for ten consecutive assessment years out of a fifteen-year block at the Developer's option. The deduction is subject to the section 80-IA machinery provisions (sub-section (5) and sub-sections (7) to (12) of section 80-IA applying). The deduction is not available where the development of the SEZ begins on or after 1 April 2017.
A. SECTION COMMENTARY
A.1 Structural position
Section 80-IAB is the SEZ-developer deduction, the developer-side counterpart of the SEZ-unit exemption in section 10AA. It borrows the section 80-IA machinery and is subject to the same nexus and computation principles. It is closed where the development of the SEZ begins on or after 1 April 2017.
A.2 Provision taxonomy
A 100-per-cent, ten-year (out of fifteen) deduction for an SEZ Developer, with the section 80-IA(5) and (7)-(12) machinery applying — the computation fiction, market-value and anti-abuse rules.
A.3 Core doctrinal themes
'Derived from the business of developing the SEZ', the section 80-IA(5) fiction, and the developer status are the operative questions; the section 80-IA jurisprudence applies.
A.4 Legislative evolution / FA amendment trail
Inserted by the Special Economic Zones Act, 2005 (w.e.f. 10 February 2006). By the proviso to sub-section (1), the deduction is unavailable to a Developer where the development of the SEZ begins on or after 1 April 2017. Not amended by the Finance Act, 2026.
A.5 CA practitioner pointers
(1) Apply the section 80-IA machinery and nexus principles. (2) Confirm the date on which development of the SEZ began against the 1 April 2017 cut-off. (3) Distinguish the developer deduction (80-IAB) from the SEZ-unit exemption (10AA). (4) Observe the section 80AC due-date condition.
B. FA 2026 IMPACT NOTE
Section 80-IAB is NOT amended by the Finance Act, 2026; it is closed where the development of the SEZ begins on or after 1 April 2017, and the section 80-IA machinery continues to apply.
C. CASE LAW — CLUSTERED BY ISSUE
Cluster C-1 : Section 80-IA machinery applied to the SEZ developer
Applied authorities: Liberty India (2009) 317 ITR 218 (SC); Velayudhaswamy Spinning Mills (2012) 340 ITR 477 (Mad)
Facts: Section 80-IAB borrows the section 80-IA(5) and (7)-(12) machinery and the 'derived from' formula.
Issue: How the nexus and computation questions are resolved for section 80-IAB.
Held: The section 80-IA principles apply: only profits with a first-degree nexus to the SEZ-development business qualify (Liberty India), and the sub-section (5) fiction operates from the initial year (Velayudhaswamy).
Ratio: Section 80-IAB is governed by the section 80-IA line of authority.
Relevance: Avoids duplicating settled law; the section 80-IA authorities control.
