Section 80PA allowed a Producer Company, as defined in section 581A(l) of the Companies Act, 1956, with a total turnover of less than one hundred crore rupees in the previous year, a deduction of one hundred per cent of the profits and gains attributable to its eligible business.
Eligible business meant marketing agricultural produce grown by the members, purchasing agricultural implements, seeds, livestock or other articles for supply to the members, or processing the members' agricultural produce. The deduction applied only for previous years relevant to assessment years "commencing on or after the 1st day of April, 2019, but before the 1st day of April, 2025", that is, assessment years 2019-20 to 2024-25.
Operative consequences
The turnover test was applied year by year; a Producer Company with a total turnover of one hundred crore rupees or more in a year got no deduction for that year.
Where the company was also entitled to another Chapter VI-A deduction, s. 80PA was worked on the income as reduced by that deduction (sub-section (2)).
Being a heading C deduction, it required the return to be furnished by the due date under s. 139(1) (s. 80AC).
Status
Not operative for assessment year 2026-27: the window in sub-section (1) closed with assessment year 2024-25. The Finance Act, 2026 does not amend this section.
The 1961 Act governs assessment year 2026-27 and earlier years; the Income-tax Act, 2025 governs tax year 2026-27 onwards, and for this subject the 2025 Act has no corresponding provision. Under s. 536(2) of the 2025 Act, the repeal does not affect the previous operation of the 1961 Act or anything duly done under it.
Case Laws & Commentary
SECTION 80PA — DEDUCTION IN RESPECT OF CERTAIN INCOME OF PRODUCER COMPANIES
Case Laws & Commentary (Income-tax Act, 1961 as amended by Finance Act, 2026)
STATUTORY SCHEME (editorial summary — verbatim bare-Act text in the companion Block-1 file)
Marginal heading: Deduction in respect of certain income of Producer Companies.
Section 80PA allows a Producer Company (as defined in the Companies Act) having a total turnover of less than Rs 100 crore in the previous year, whose gross total income includes profits and gains derived from eligible business — the marketing of agricultural produce grown by its members, the purchase of agricultural implements, seeds, livestock or other articles for supply to its members, or the processing of the agricultural produce of its members — a deduction of 100 per cent of the profits and gains attributable to such eligible business. The deduction was available for assessment years 2019-20 to 2024-25.
A. SECTION COMMENTARY
A.1 Structural position
Section 80PA extends a co-operative-style 100-per-cent deduction to Producer Companies (which, being companies, are not co-operative societies eligible under section 80P) for their agricultural-marketing / supply / processing income. Its operative window has lapsed.
A.2 Provision taxonomy
A 100-per-cent deduction on profits from the eligible agri-business of a sub-Rs-100-crore-turnover Producer Company, with a no-double-deduction rule against any other Chapter VIA heading-'C' deduction.
A.3 Core doctrinal themes
The operative questions are the Producer-Company status, the turnover threshold, and the attribution of profits to the eligible agri-business. The provision is recent and the operative window short; reported litigation is limited.
A.4 Legislative evolution / FA amendment trail
Inserted by the Finance Act, 2018, available for assessment years 2019-20 to 2024-25. Not extended; not amended by the Finance Act, 2026.
A.5 CA practitioner pointers
(1) Confirm Producer-Company status and the sub-Rs-100-crore turnover for the relevant year. (2) Attribute profits to the eligible agri-business. (3) Available only up to assessment year 2024-25 unless re-enacted; observe the section 80AC due-date condition for the years it applied.
B. FA 2026 IMPACT NOTE
Section 80PA is NOT amended by the Finance Act, 2026; its operative window (assessment years 2019-20 to 2024-25) has lapsed and it is relevant for those years.
Facts: A Producer Company below the turnover threshold claims the deduction on its agri-business profits.
Issue: What governs eligibility and quantum.
Held: Eligibility turns on Producer-Company status, the turnover threshold and the attribution of profits to the listed eligible agri-business; the deduction is 100 per cent of such profits, subject to the no-double-deduction rule.
Ratio: A turnover-gated, activity-specific full deduction for Producer Companies.
Relevance: States the operative framework for a recent, short-window provision; reported litigation is limited.
