Section 80EEB — Interest on Electric Vehicle Loan

STATUTORY ARCHITECTURE — 18-ROW MAP

Function in the statutory architecture

Section 80EEB allows an individual to deduct interest payable on a loan taken from a financial institution for the purchase of an electric vehicle. The deduction cannot exceed one hundred and fifty thousand rupees and is allowed for assessment year 2020-21 and subsequent assessment years. The only condition on the loan is that it was sanctioned between 1 April 2019 and 31 March 2023.

An "electric vehicle" is one powered exclusively by an electric motor whose traction energy comes exclusively from a traction battery installed in the vehicle, with a regenerative braking system. A "financial institution" is a banking company, a bank or banking institution under s. 51 of the Banking Regulation Act, 1949, a deposit-taking non-banking financial company or a systemically important non-deposit-taking non-banking financial company.

Operative consequences

  • Interest deducted under this section cannot be deducted under any other provision of the Act for the same or any other assessment year (s. 80EEB(4)).
  • A loan sanctioned after 31 March 2023 does not qualify.
  • Under the default regime, s. 115BAC(2)(i) disallows this deduction.

Status

Operative for assessment year 2026-27 for loans sanctioned within the window; time-limited only in that no new loan can qualify. The Finance Act, 2026 does not amend s. 80EEB.

The Income-tax Act, 1961 governs assessment year 2026-27 and earlier years; the Income-tax Act, 2025 governs tax year 2026-27 onwards. For this subject, the corresponding provision is s. 132, whose definition of "financial institution" includes any non-banking financial company.

Case Laws & Commentary (Income-tax Act, 1961 as amended by Finance Act, 2026)

STATUTORY SCHEME (editorial summary — verbatim bare-Act text in the companion Block-1 file)

Marginal heading: Deduction in respect of purchase of electric vehicle.

Section 80EEB allows an individual a deduction of up to Rs 1,50,000 in respect of interest payable on a loan taken from a financial institution for the purchase of an electric vehicle, where the loan was sanctioned during the period 1 April 2019 to 31 March 2023. Where the interest is claimed under section 80EEB, the same interest cannot be claimed under any other provision of the Act for the same or any other assessment year. Where the vehicle is used for business, interest above Rs 1,50,000 may be claimed as a business expense subject to the usual conditions.

A. SECTION COMMENTARY

A.1 Structural position

Section 80EEB is the electric-vehicle-loan interest deduction, a green-mobility incentive. It is confined to loans sanctioned between 1 April 2019 and 31 March 2023 and is therefore closed to fresh borrowers, surviving for eligible legacy loans.

A.2 Provision taxonomy

A capped (Rs 1,50,000) interest deduction for an electric-vehicle loan from a financial institution, with a sanction window, and a no-double-deduction bar against any other provision.

A.3 Core doctrinal themes

Eligibility (sanction window, electric vehicle, financial-institution loan) and the bar on claiming the same interest under another provision. The provision is recent and documentary; reported litigation is negligible.

A.4 Legislative evolution / FA amendment trail

Inserted by the Finance (No. 2) Act, 2019 for loans sanctioned from 1 April 2019; the sanction window runs to 31 March 2023 and has not been extended. Not amended by the Finance Act, 2026; unavailable under the default regime.

A.5 CA practitioner pointers

(1) Confirm the loan sanction date falls within 1 April 2019 to 31 March 2023 and the vehicle is an electric vehicle financed by a financial institution. (2) The same interest cannot be claimed under any other provision. (3) For a business-use vehicle, interest beyond Rs 1,50,000 may be a business deduction, subject to the usual conditions. (4) Unavailable under the default regime.

B. FA 2026 IMPACT NOTE

Section 80EEB is NOT amended by the Finance Act, 2026; it applies only to loans sanctioned between 1 April 2019 and 31 March 2023 and remains available (for eligible legacy loans) only under the old regime.

C. CASE LAW — CLUSTERED BY ISSUE

Cluster C-1 : Eligibility and the no-double-deduction rule

Note on the case-law field for section 80EEB

Facts: Section 80EEB is a capped electric-vehicle-loan interest deduction confined to FY 2019-20 to 2022-23 sanctions.

Issue: Whether substantial interpretive case law exists.

Held: It does not; the section is recent, documentary and tightly conditioned.

Ratio: Eligibility turns on the sanction window, the electric-vehicle and financial-institution conditions, and the bar on double deduction.

Relevance: States candidly the scarcity of authority and identifies the operative conditions.

Editorial note on sourcing

Editorial scheme summary prepared from the Income-tax Act, 1961 as amended by the Finance Act, 2025, read with the Finance Act, 2026; verbatim bare-Act text is carried in the companion Block-1 treatise file. Case law is restricted to reported Supreme Court / High Court authority verified against standard law reports (ITR/Taxman/CTR); for documentary, payment-based deductions that generate little appellate litigation, that scarcity is stated candidly and the governing statutory/CBDT material is given.
