Section 80JJA allows a deduction where the gross total income of any assessee includes profits and gains derived from the business of collecting and processing or treating bio-degradable waste for generating power, producing bio-fertilisers, bio-pesticides or other biological agents, producing bio-gas, or making pellets or briquettes for fuel or organic manure.
The deduction is an amount equal to the whole of such profits and gains for five consecutive assessment years, beginning with the assessment year relevant to the previous year in which the business commences. The section sets no turnover limit, no class of assessee and no separate certification requirement.
Operative consequences
Only profits "derived from" the specified waste-processing business qualify; other income of the assessee is not covered.
The five-year period is fixed by the year in which the business commences, not by the year of the first claim.
Being a deduction under heading C of Chapter VI-A, it is allowed only if the return is furnished on or before the due date under s. 139(1) (s. 80AC).
Where total income is computed under s. 115BAC(1A), s. 115BAC(2)(i) excludes deductions under Chapter VI-A other than those under ss. 80CCD(2), 80CCH(2) and s. 80JJAA, so this deduction is not available in that case.
Status
Operative for assessment year 2026-27. The section has no bracketed note or sunset clause. The Finance Act, 2026 does not amend this section.
The 1961 Act governs assessment year 2026-27 and earlier years; the Income-tax Act, 2025 governs tax year 2026-27 onwards, and for this subject the 2025 Act provision is s. 145. Section 145 lists the four end-uses as separate clauses, (a) to (d), and counts the five tax years from the tax year in which the business commences.

Case Laws & Commentary (Income-tax Act, 1961 as amended by Finance Act, 2026)
STATUTORY SCHEME (editorial summary — verbatim bare-Act text in the companion Block-1 file)
Marginal heading: Deduction in respect of profits and gains from business of collecting and processing of bio-degradable waste.
Section 80JJA allows an assessee whose gross total income includes profits and gains derived from the business of collecting and processing or treating bio-degradable waste for generating power, or producing bio-fertilisers, bio-pesticides or other biological agents, or producing bio-gas, or making pellets or briquettes for fuel or organic manure, a deduction of the whole of such profits and gains for five consecutive assessment years beginning with the year of commencement.
A. SECTION COMMENTARY
A.1 Structural position
Section 80JJA is a green-economy incentive for businesses that collect and process bio-degradable waste. It is a 100-per-cent, five-year deduction on the profits 'derived from' that business.
A.2 Provision taxonomy
A full deduction for five years on profits derived from the specified bio-waste processing activities, computed on profits with the requisite nexus to that business.
A.3 Core doctrinal themes
The operative questions are whether the activity falls within the listed bio-waste processes and the 'derived from' nexus; reported litigation is limited.
A.4 Legislative evolution / FA amendment trail
Inserted by the Finance (No. 2) Act, 1998 and refined to cover the various bio-products. Not amended by the Finance Act, 2026.
A.5 CA practitioner pointers
(1) Confirm the activity is within the listed bio-waste processes. (2) The five-year period runs from commencement. (3) Apply the 'derived from' nexus to ancillary receipts.
B. FA 2026 IMPACT NOTE
Section 80JJA is NOT amended by the Finance Act, 2026; the five-year, 100-per-cent deduction continues for eligible businesses.
C. CASE LAW — CLUSTERED BY ISSUE
Cluster C-1 : Scope of the eligible activity and nexus
Statutory scope and shared 'derived from' jurisprudence
Facts: An assessee processes bio-degradable waste into the listed products and claims the deduction.
Issue: What governs eligibility and quantum.
Held: Eligibility turns on the activity falling within the listed bio-waste processes; quantum follows the 'derived from' nexus (Sterling Foods / Pandian Chemicals), excluding ancillary receipts.
Ratio: A conditional, activity-specific full deduction governed by the general profit-linked nexus principles.
Relevance: States the operative framework; reported litigation is limited and the general nexus authorities apply.
