Section 80AB — Computation of GTI for VI-A Purposes

STATUTORY ARCHITECTURE — 18-ROW MAP

Function in the statutory architecture

Section 80AB governs every deduction under the heading "C.—Deductions in respect of certain incomes" in Chapter VI-A that is given in respect of income of a particular nature included in gross total income. It overrides the wording of the individual section: the amount of that income, as computed under the provisions of the Act before any Chapter VI-A deduction, is alone deemed to be the income of that nature derived or received by the assessee and included in his gross total income.

The section works with s. 80B(5), which defines "gross total income" as total income computed under the Act before any deduction under Chapter VI-A, and with s. 80A(2), which caps the aggregate deductions at gross total income.

Operative consequences

  • A Part C deduction is measured on the income as computed under the Act, net of the allowances and deductions that the Act makes in computing it, not on gross receipts.
  • Where the computed income of the relevant nature is nil or a loss, there is no income on which the deduction can operate.
  • The rule applies "notwithstanding anything contained in that section", so it prevails over different wording in the deduction section itself.

Status

Operative for assessment year 2026-27. Not omitted and not time-limited. The Finance Act, 2026 does not amend s. 80AB.

The Income-tax Act, 1961 governs assessment year 2026-27 and earlier years; the Income-tax Act, 2025 governs tax year 2026-27 onwards. For this subject, the corresponding provision is s. 122(9).

SECTION 80AB — DEDUCTIONS TO BE MADE WITH REFERENCE TO THE INCOME INCLUDED IN THE GROSS TOTAL INCOME

STATUTORY SCHEME (editorial summary — verbatim bare-Act text in the companion Block-1 file)

Marginal heading: Deductions to be made with reference to the income included in the gross total income.

Section 80AB provides that, for the purpose of any deduction under the heading 'C.—Deductions in respect of certain incomes' in Chapter VIA, where any deduction is required to be allowed in respect of any income of the nature specified in that section which is included in the gross total income, the amount of income of that nature as computed in accordance with the provisions of the Act (before making any deduction under Chapter VIA) shall alone be deemed to be the amount of income of that nature which is derived or received by the assessee and which is included in his gross total income. In effect, income-linked deductions are computed on the net income of the specified nature (gross receipts less the expenditure and losses attributable to it), not on the gross receipts.

A. SECTION COMMENTARY

A.1 Structural position

Section 80AB, inserted by the Finance (No. 2) Act, 1980 with effect from 1 April 1981, is a non-obstante, computation-governing provision for the heading-'C' deductions. It overrides anything to the contrary in those sections and fixes the quantum on which the percentage deduction operates. It is the statutory embodiment of the 'net income' principle and the legislative answer to the line of cases that had allowed deductions on gross income.

It works in tandem with section 80A (base and ceiling) and section 80B(5) (gross total income). Section 80AB does not create a deduction; it tells you the figure of the specified income on which the deduction section operates.

A.2 Provision taxonomy

The provision is a deeming and computation rule. Its operative elements are: (i) it applies to any heading-'C' deduction 'in respect of any income'; (ii) the income of that nature is to be 'computed in accordance with the provisions of this Act' — i.e. after the deductions and adjustments the Act otherwise requires; and (iii) that computed (net) figure 'alone' is deemed to be the income included in the gross total income for the deduction. The word 'alone' is the operative limiter.

A.3 Core doctrinal themes

The dominant theme is net-versus-gross: a deduction expressed as a percentage of an income of a specified nature is to be applied to the net amount of that income after deducting the expenditure (and, where applicable, the losses and allowances) attributable to it, not to the gross receipts. A connected theme is the relationship between section 80AB and the individual deduction sections — section 80AB prevails, so an argument built on the language of the deduction section alone cannot displace the net-income mandate.

A.4 Legislative evolution / FA amendment trail

Section 80AB was inserted by the Finance (No. 2) Act, 1980 with effect from 1 April 1981 to overcome the construction that deductions could be claimed on gross income. The closely related section 80AA (computation of the section 80M deduction on net dividend) was inserted by the same Finance Act with retrospective effect from 1 April 1968 and was later omitted from 1 April 1998 once section 80M was recast. Section 80AB itself is not amended by the Finance Act, 2026.

A.5 CA practitioner pointers

(1) For every income-linked (heading-'C') deduction, first compute the net income of the specified nature after attributable expenditure; apply the percentage to that net figure. (2) Where the eligible activity has a loss in one unit and profit in another, net them before applying the deduction (the IPCA / netting principle for 80HHC). (3) Remember section 80AB overrides the deduction section; do not rely on the gross language of, say, section 80-O or 80QQB in isolation. (4) Read section 80AB with section 80B(5): the deduction is from gross total income, and the income on which it is measured is the net specified income.

B. FA 2026 IMPACT NOTE

Section 80AB of the Income-tax Act, 1961 is NOT amended by the Finance Act, 2026. The net-income computation mandate continues to govern every heading-'C' deduction for assessment year 2026-27.

C. CASE LAW — CLUSTERED BY ISSUE

Cluster C-1 : The net-income principle — deduction on net, not gross

Distributors (Baroda) (P) Ltd. v. Union of India (1985) 155 ITR 120 (SC)

Facts: The assessee claimed the inter-corporate dividend deduction (then section 80M) on the gross dividend received, relying on the earlier decision in Cloth Traders (P) Ltd. v. Addl. CIT (1979) 118 ITR 243 (SC). Section 80AA had been inserted retrospectively to require computation on net dividend.

Issue: Whether the deduction is to be computed on the gross income of the specified nature or on the net income after deducting the expenditure incurred in earning it.

Held: A larger Bench of the Supreme Court overruled Cloth Traders and upheld section 80AA, holding that the deduction is allowable only on the net dividend, i.e. the dividend income as computed under the Act after deducting the expenditure (such as interest on borrowings) attributable to earning it.

Ratio: A deduction in respect of an income of a specified nature is to be computed on the net amount of that income included in the gross total income, not on the gross receipts.

Relevance: The foundational authority for the net-income principle that section 80AB enacts generally for all heading-'C' deductions.

H. H. Sir Rama Varma v. CIT (1994) 205 ITR 433 (SC)

Facts: The assessee sought a Chapter VIA income-linked deduction without reducing the specified income by the losses and expenditure attributable to it.

Issue: Whether, after the insertion of section 80AB, the deduction is to be computed on the income of the specified nature as reduced by attributable losses and expenditure.

Held: The Supreme Court held that section 80AB has an overriding effect and that the deduction must be computed with reference to the net income of the specified nature included in the gross total income, after setting off the related losses and expenditure.

Ratio: Section 80AB controls the quantum of every heading-'C' deduction and mandates a net-income computation notwithstanding the language of the particular deduction section.

Relevance: Confirms the overriding character of section 80AB and the net-income mandate beyond the dividend context.

Cluster C-2 : Computation 'in accordance with the Act' — depreciation and unabsorbed allowances

Cambay Electric Supply Industrial Co. Ltd. v. CIT (1978) 113 ITR 84 (SC)

Facts: In computing the deduction then available under section 80E (for specified priority industries), the question was whether unabsorbed depreciation and unabsorbed development rebate of earlier years had first to be deducted in arriving at the profits attributable to the priority business.

Issue: Whether 'profits and gains attributable to the business' for the deduction are the profits computed in accordance with the Act (after depreciation and other allowances) or a higher commercial figure.

Held: The Supreme Court held that the profits had to be computed in accordance with the provisions of the Act; unabsorbed depreciation and unabsorbed development rebate of earlier years must be deducted before arriving at the figure on which the deduction is allowed.

Ratio: Income for a Chapter VIA income-linked deduction is the income 'as computed under the Act', i.e. net of statutory allowances and set-offs.

Relevance: The early statement of the principle later codified in section 80AB; routinely applied to the computation base of income-linked deductions.
