Section 195 — - TAX ON UNEXPLAINED CASH CREDITS / INVESTMENTS / MONEY

Section 195 is the substantive equivalent of 1961 s. 115BBE -- the SPECIAL FLAT-RATE provision for income deemed under ss. 102-106 (Chapter VI Aggregation -- equivalent of 1961 ss. 68 / 69 / 69A / 69B / 69C / 69D unexplained-receipts). Where total income includes cash credits / unexplained investments / unexplained money / unexplained expenditure / amount borrowed-or-repaid-on-hundi -- AO charges FLAT 60% rate (post FA 2017 enhancement from 30% / FA 2016). Plus 25% surcharge typically and 4% cess. Effective rate ~78%. NO basic exemption / Chapter VIII deductions / loss set-off / Chapter IX rebates. The harsh-rate regime targets demonetisation-era / high-cash-deposit / unexplained-source income.

STATUTORY ARCHITECTURE: trigger - return discloses income under any of Chapter VI deemed-aggregation provisions: s. 102 (cash credits / 1961 s. 68); s. 103 (unexplained investments / 1961 s. 69); s. 104 (unexplained money / 1961 s. 69A); s. 105 (unexplained expenditure / 1961 s. 69C); s. 106 (hundi-borrowing / 1961 s. 69D). Or AO determines such under search / scrutiny. RATE: 60% flat + applicable surcharge (25% typically applies for total-tax >INR 50L / over INR 1cr) + 4% cess. Effective: ~78%. No basic exemption shielding. No Chapter VIII deduction (incl. NPS / 80C etc.). No loss set-off (current or c/f). No Chapter IX rebate. PENALTY (s. 271AAC equivalent): 10% additional. CASE LAW: ITAT decisions on FA 2017 increase from 30% to 60%; demonetisation-era cash-deposit cases (Nov 2016 Rs.500/1000 demonetisation) extensively litigated. PRACTITIONER: voluntary-disclosure does NOT escape -- once disclosed in return as Chapter VI income, 60% flat. Strategic alternative: substantively explain source / nexus to legitimate income BEFORE disclosure to avoid deemed-aggregation classification.
